FASTRAK EVOLUTION ANDROID APP PRIVACY POLICY

TarpStop, LLC (“Company,” “we,” “our,” or “us”) is committed to being transparent about our data collect and use practices. This Privacy Policy (“Policy”) details the types of information that we collect when you use the Fastrak Evolution Android App (the “App”), and how we use and disclose that information. Please note that this Policy applies exclusively to the App and not any other product, service, or website of the Company. References in this Policy to “you” or “your” is intended to refer to you, the end user of the App.
We encourage you to carefully review this Policy to understand our policies and practices concerning the data we collect and your privacy. If you do not agree with the terms and conditions of this Policy, you may not download, register, or use the App. By using the App or clicking “Agree” to the End User License Agreement for the App, you agree to be bound by the terms and conditions of this Policy.
Geographic Restrictions
Please note that this App is made available for use exclusively in the United States. If you choose to use the App outside of the United States, you do so exclusively at your own risk and you are solely responsible for your compliance with any applicable laws or violations thereof.
What Information is Collected From the App?
We may collect the following information when you agree to the End User License Agreement or when you select to send telemetry information from your TarpStop product:
- Continuous Fastrak state, usage, and location (GPS coordinates)
- App state and usage
- Mobile device unique identifier, IP address and location (GPS coordinates)
How is the Information Collected from the App Used by Company?
We use the information that we collect from you and your TarpStop product to understand where our TarpStop products are used and the states that TarpStop products travel through. This information is collected and used for internal business purposes, including future growth, advertising, troubleshooting, quality tracking and marketing plans.
Does the Company Share Information that it Collects from the App with Third Parties?
We do not sell, trade, or lease your information to any third parties. We do not use any of the information collected from or through the App for any direct marketing purposes.
In order to make our App available to you we may utilize a number of third party service providers, who provide us with an array of services, including data and web hosting, software, marketing, advertising, logistics, payment card processing, and other professional services. We do not permit these third party service providers, who may collect or store information on our behalf, to use your information except as required for such third party service providers to render their services to us. We will also disclose the information that we have collected about you under the following circumstances:
- To comply with a court order, law, or legal process, including in response to a subpoena, or a government or regulatory request; and
- To a buyer or a successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of TarpStop’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by TarpStop, to the extent we have such information, will be among the assets transferred.
Children’s Online Privacy
All users of the App must be at least eighteen (18) years of age. Company does not knowingly market, solicit, or collect personal information from persons under the age of thirteen (13) years of age. For purposes of this Policy, the term “personal information” has the meaning set forth under the federal Children’s Online Privacy Protection Act, which is set forth in 15 U.S.C. § 6501, et. al. and its regulations. If you are the parent or legal guardian of a child that is under eighteen (18) years of age and you believe that your child may have provided us with personal information, please contact us using the contact details listed at the bottom of this document to have their personal information deleted from our system.
Your Choices About Our Collection, Use and Disclosure of Information
You may choose to share location data from your TarpStop product through your mobile device and on to TarpStop. You may disable your mobile device’s location function. You may also delete the App from your mobile device at any time, at your sole and absolute discretion, at which point in time we will no longer receive any data from you.
Changes to this Policy
We reserve the right to update this Policy periodically at our sole discretion. Any time we choose to revise this Policy, we will update the “Last Modified Date” listed at the top of this document. Except as otherwise required by applicable law, in the event that we make a material change to this Policy with respect to how we collect, use, or disclose information, we will provide notice to you within the App to direct your attention to this Policy so that you may inform yourself of the changes. Please note that it is your exclusive responsibility to regularly check and keep yourself advised of any changes to this Policy as such changes are binding upon you. Revisions to this Policy will become effective upon their posting unless otherwise noted in writing by Company or required by applicable law. If you do not agree with any revision to this Policy, then you must immediately cease your use of the App and delete all copies of the App from your computing device and account.
